Terms of Service

Welcome to OYAJITCG. These Terms are the agreement between you and the operator of OYAJITCG. Please read them. They are written to be short and plain.

1. Who we are

1.1 OYAJITCG is an unofficial companion app for trading card games, available for iOS and Android, together with the website oyajitcg.com (the "Service").

1.2 The Service is operated by Jorge Ribeiro, an individual trading as OYAJITCG ("we", "us"). Contact: [email protected].

1.3 By creating an account or using the Service you accept these Terms and our Privacy Policy (oyajitcg.com/privacy). If you do not accept them, do not use the Service.

1.4 Your consumer rights come first. If you are a consumer, the law of the country where you live may give you rights that cannot be taken away by contract. Nothing in these Terms limits those rights.

2. What the Service is

2.1 OYAJITCG lets you browse cards and sealed products for the games it covers, track your collection, wishlist and decks, log what you spent, follow the estimated value of your collection, set release reminders and scan cards with your camera.

2.2 OYAJITCG is a tool for collectors and players. It is not a shop or marketplace, not a valuation or grading service and not a game client. You cannot buy anything inside the app today (see section 6).

2.3 The Service covers English language editions unless the app says otherwise. Some products, events and shops are specific to certain countries.

2.4 The Service is free to use. Some features have usage limits (for example a monthly number of scans).

3. Accounts

3.1 You can create an account with your email address (we send you a one-time login code), with Sign in with Google or with Sign in with Apple. You need an account to save your collection and sync it across devices.

3.2 Give accurate information and keep access to your email and sign-in accounts secure. Tell us at [email protected] if you think someone else has used your account.

3.3 One person, one account. Accounts are personal and may not be sold or transferred.

3.4 You must meet the age requirements in section 11.

4. Acceptable use

You agree not to:

• break the law or anyone else's rights while using the Service;
• use a display name, deck name or note that is illegal, hateful, harassing, sexually explicit, defamatory or infringing;
• create multiple accounts to get around limits or promotions;
• copy, scrape, download in bulk or redistribute the database, card images, prices or other content of the Service, or use it to build a competing product;
• reverse engineer the app or bypass its security or usage limits, except where the law expressly allows it;
• overload, disrupt or attack the Service, or access other users' data;
• use the Service for commercial resale of data or automated access.

If you break these rules we may, depending on how serious it is, warn you, remove content, limit features, or suspend or close your account. Except in urgent cases (fraud, illegality, security risk) we will tell you why first and give you a chance to respond.

5. Your content

5.1 Your collection, wishlist, decks, spend log, notes and display name ("your content") remain yours.

5.2 You allow us to store, back up, sync and display your content only as needed to run the Service for you. This permission ends when you delete the content or your account, apart from short-lived backups described in the Privacy Policy.

5.3 You can export your data from the app at any time (Profile > Account > Export my data) or by emailing [email protected].

6. Prices, links and purchases

6.1 Prices are information only. Prices shown in the Service come from third-party sources, currently public price data from TCGplayer and Cardmarket, updated daily and shown for information only. We have no partnership with these sources. They may be delayed, incomplete, converted between currencies, specific to one market, or wrong. They are not an offer to buy or sell, not an appraisal, not a valuation for insurance or tax, and not financial or investment advice. Collection values, spend totals and profit or loss figures are estimates based on those prices and on what you entered.

6.2 You alone decide whether to buy, sell, trade, insure or grade anything. Check the market before you do.

6.3 Names of price sources and marketplaces are trademarks of their owners and are used only to identify the source. Their mention does not mean they sponsor or endorse OYAJITCG.

6.4 No purchases in the app. You cannot buy cards or products in OYAJITCG. Links to shops or marketplaces open outside the app, after a notice that you are leaving OYAJITCG. Any purchase is a contract between you and that seller under its terms. We are not responsible for their prices, stock, delivery, authenticity or customer service.

6.5 Affiliate links (FUTURE). Some shop links may become affiliate links. If so, they will be marked in the app, and we may earn a commission at no extra cost to you. We do not rank products by commission.

7. Paid plans (FUTURE)

7.1 Today the Service is free. We may later offer optional paid plans with convenience features such as value history, profit and loss tools, alerts and VIP features. Card data and the core collection features stay free; paid plans never sell access to card information.

7.2 Paid plans will be sold only through Apple In-App Purchase on iOS and Google Play Billing on Android. Apple or Google will charge you, in your currency and with taxes for your country. We will never see your card details.

7.3 Before you buy, the app will show the plan, what it includes, the price, the billing period, that subscriptions renew automatically until cancelled, and how to cancel. That screen forms part of your contract.

7.4 You can cancel a subscription at any time in your Apple or Google account settings, at least 24 hours before renewal to avoid the next charge. You keep the paid features until the end of the period already paid. Deleting your OYAJITCG account does not cancel a store subscription.

7.5 Refunds are handled by Apple (support.apple.com/118223) or Google Play (support.google.com/googleplay/answer/2479637) under their policies, without affecting your legal rights. If you are a consumer in the EU or UK, you may have a 14 day right of withdrawal for distance contracts; for digital content supplied immediately, that right can end once supply starts with your express consent, which the purchase flow will ask for where required.

8. Intellectual property and publisher disclaimers

8.1 Unofficial. OYAJITCG is an independent, unofficial fan-made app. It is not affiliated with, endorsed, sponsored, supported or approved by any card game publisher.

8.2 Their property. OYAJITCG is not affiliated with, endorsed by or sponsored by any card game publisher. Card names and images are trademarks and copyrights of their respective owners. They are shown only to identify cards and products so you can manage your collection. We claim no ownership of them, and this notice is not a licence.

8.3 Our property. The OYAJITCG name, logo and brush artwork, the app design, software, original icons and the structure of our database belong to Jorge Ribeiro. We give you a personal, non-exclusive, non-transferable, revocable licence to use the Service for private, non-commercial purposes under these Terms.

8.4 Rights holders. If you own rights in something shown in the Service and want it changed or removed, email [email protected] with the subject "Rights notice", identifying yourself, the right, the exact content and what you ask us to do. We acknowledge within 3 business days and we will cooperate.

8.5 Apple, App Store, Google and Google Play are trademarks of their owners.

9. Availability and changes to the Service

9.1 We may update, add or remove features, games, images or price sources, in particular if a rights holder or data source asks us to.

9.2 The Service may be unavailable from time to time for maintenance or reasons outside our control. We do not promise uninterrupted availability. Keep your own export of anything important.

10. Age

10.1 You must be at least 13 to create an account. If you live in the European Economic Area or the United Kingdom and are below your country's age of digital consent (between 13 and 16), you need a parent's or guardian's permission.

10.2 If you are under 18, a parent or guardian should agree to these Terms with you, and must approve any future purchase (Apple Screen Time and Google Family Link can manage this).

10.3 If we learn that a child under 13 has an account, we will close it and delete the data.

11. Liability

11.1 Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, fraud, wilful misconduct or gross negligence, or your statutory consumer rights.

11.2 Within those limits:

• the Service is provided free of charge, "as is" and "as available";
• we are not liable for decisions you take based on information in the Service, including prices, values, release dates and reminders;
• we are not liable for third-party services we do not control (app stores, sign-in providers, shops, marketplaces, price sources) or for events beyond our reasonable control;
• we are not liable for indirect loss, loss of profit or loss of business; the Service is for private use;
• our total liability to you is limited to the higher of what you paid us in the 12 months before the claim and EUR 50.

11.3 For consumers in the EU, EEA and UK, these limits apply only as far as your national consumer law allows.

12. Ending your use and termination

12.1 You can stop using the Service and delete your account at any time in the app (Profile > Account > Delete account), at oyajitcg.com/delete-account, or by emailing [email protected]. Deletion is permanent; export first if you want to keep your data (Profile > Account > Export my data).

12.2 We may suspend or close accounts that seriously or repeatedly break these Terms (section 4).

12.3 We may discontinue the Service. Except where an immediate stop is legally required, we will give at least 90 days' notice in the app and by email, and you will be able to export your data during that time. If paid plans exist by then, unused prepaid periods will be refunded as the law and the stores allow.

13. Changes to these Terms

We may update these Terms for good reason, such as new features, paid plans, a change of operator (for example to a company) or a change in the law. We will announce material changes in the app at least 30 days before they apply, unless the law or a rights holder requires a shorter period. If you do not agree, you can delete your account. The current version is always at oyajitcg.com/terms.

14. Governing law and disputes

14.1 These Terms are governed by Portuguese law. The courts of Lisbon have jurisdiction, without prejudice to the mandatory rights of consumers described in 14.2.

14.2 If you are a consumer living in another country, you keep the protection of the mandatory consumer laws of that country, and you can bring a claim in the courts where you live. We can only bring a claim against you there.

14.3 Before going to court, please contact us at [email protected]; we reply within 15 working days.

14.4 Consumers in Portugal: you can file a complaint in the electronic complaints book at www.livroreclamacoes.pt, and you can use a consumer dispute resolution entity such as CNIACC, Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (www.cniacc.pt). More information at www.consumidor.gov.pt.

14.5 Consumers elsewhere in the EU can find national consumer dispute resolution bodies in the list published by the European Commission at consumer-redress.ec.europa.eu.

15. General

15.1 If any clause is invalid, the rest stays in force.

15.2 Not enforcing a right straight away does not waive it.

15.3 You may not transfer your rights under these Terms. We may transfer the Service and these Terms to a company or another operator; we will tell you beforehand, and if the transfer reduces your rights you may end the contract.

15.4 These Terms are written in English, the language of the Service.

15.5 Apple and Google are not parties to these Terms and are not responsible for the Service or its support. For the iOS app, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Apple's standard Licensed Application End User License Agreement (www.apple.com/legal/internet-services/itunes/dev/stdeula) also applies, in addition to these Terms.
